BROCK MÜLLER ZIEGENBEIN represents pharmacists and consumers before the Cologne Administrative Court in an action against the Federal Republic of Germany to update the so-called country list

The so-called list of countries, which is based on Section 73 para. 1 sentence 3 of the German Medicines Act, shows which countries have comparable safety standards to those in Germany with regard to the mail-order sale of medicines.

This list has not been updated since 2011 and the Netherlands is currently also on this list. After the Ministry of Health failed to respond to the application to update the so-called country list with the proviso that the Netherlands be removed from the list for over three months, an action for failure to act has now been filed. The aim of the action is to ensure that the mail-order sale of prescription medicines from the Netherlands to Germany is no longer possible as long as there are no comparable safety standards for the mail-order sale of medicines in the Netherlands.
