Bernd Richter specialises in advising and representing companies, their shareholders and executive bodies in disputes involving corporate law, antitrust law and tax law.
In the area of corporate law, shareholder disputes in all their facets are at the centre of his advisory activities. If the dispute cannot be avoided, Bernd Richter takes on both out-of-court advice and representation as well as litigation, including handling release and award proceedings. He also advises on the drafting of articles of association and employment contracts.
In antitrust law, Bernd Richter advises and represents domestic and foreign companies, associations and the public sector, in particular in merger control and antitrust administrative proceedings before the German Federal Cartel Office and the European Commission. His work begins with the internal review of antitrust-sensitive projects and advising our clients on the implementation and drafting of contracts and transaction processes in compliance with antitrust law. If antitrust law has already been violated, Bernd Richter and his team support our clients in remedying the violations, setting markers and preparing bonus applications as well as setting up practical compliance and training programmes. In line with his forensic focus, he also handles the enforcement of and defence against claims for damages and injunctive relief based on antitrust law in the context of follow-on proceedings.
As a certified lawyer specialising in tax law, Bernd Richter works closely with his clients' tax advisors in tax law disputes, from appeal proceedings to fiscal court proceedings and appeal proceedings at the Federal Fiscal Court.
Bernd Richter has been chairman of the supervisory board of a German co-operative bank for many years and advises a large number of banks, particularly from the co-operative sector, in the context of their internal and external disputes.
